Re:   Agreement between the Parties to Request the Arbitral Tribunal to be Reconstituted as a Commission of Inquiry pursuant to the Permanent Court of Arbitration Optional Rules for Fact-finding Commission of Inquiry

      Greetings and Aloha,

      We, the undersigned, acting for and on behalf of the Parties, have the honor to inform you that Mr. Lance Paul Larsen, Claimant, and the Government of the Hawaiian Kingdom, Respondent, after careful review of the Arbitral Award of February 5, 2001, did mutually agree to request that the Arbitral Tribunal, comprising of Professors James Crawford, QC, President, Gavan Griffith, QC, and Christopher Greenwood, QC, be reconstituted into a Commission of Inquiry pursuant to the Permanent Court of Arbitration's Optional Rules for Fact-finding Commission of Inquiry in order for the Parties to proceed to the merits of their case.

      This agreement has been made subsequent to Mr. Lance Paul Larsen, Claimant, by his attorney, having been in receipt of the hard copy of the Arbitral Award since March 16, 2001, and the Government of the Hawaiian Kingdom, Respondent, having been in receipt of the Arbitral Award, sent by e-mail from the Deputy Secretary General, since March 13, 2001.
