Arbitration under the UNCITRAL Rules

Arbitrators' Communication No. 1

  1. Further to the letter of the Appointing Authority, dated 28 May 2000, I write to confirm the constitution of the Tribunal.

  2. The parties have already received copies of the curricula vitae of Professor Greenwood QC and Mr. Griffith QC. That of Professor Crawford SC is attached.

  3. In terms of Article 9 of the UNCITRAL Rules, none of the arbitrators is aware of any circumstance which might give rise to "justifiable doubts as to his impartiality or independence". As he has already noted, Professor Greenwood has been counsel on a number of occasions for the United States of America before courts in the United Kingdom. Professor Crawford has been counsel for other States against the United States of America before several international courts. He is also an arbitrator in a case brought under the ICSID Additional Facility against the United States.

  4. The Tribunal would appreciate written confirmation from each of the parties, by Monday 19 June, that they accept the constitution of the Tribunal in terms of Article 11 (1) of the Rules.

  5. All communications with the Tribunal will be channeled through Secretariat of the Permanent Court of Arbitration (attention: Ms. Phyllis Hamilton). It is helpful if communications are sent initially by e-mail or fax, but in each case the original signed letter should be sent by airmail to the Secretariat, which will maintain a complete file.
